A petition filed against Prime Minister Modi Biopic seeking the stay on the film is now been rejected by Supreme Court. 

 

A Bench of Chief Justice of India Ranjan Gogoi and Justices Deepak Gupta and Sanjiv Khanna held that whether the movie violates Election laws or not is for the Election Commission to decide. The court also stated that it would not be right for us to step in our foot in this matter because the film is yet to be certified by the Central Board of Film Certification.

 

On the other hand, Senior Advocate Abhishek Manu Singhvi concern was that the movie will disturb the atmosphere of General Election which is about to happen and will disturb the level playing field.

He argued that the movie has been produced by persons with close ties to ruling dispensation including convenor of Commercial Cell of BJP. It violates the code of conduct for elections.

 

However, the court made its point very clear that it cannot interfere in this matter when the movie has not even been certified by CBFC. Moreover, the court said that it is up to Election Commission look into whether the movie affects level playing field for 2019 Lok Sabha Elections. 

 

Singhvi said The Election Commission has already approached by the petitioner but Election Commission was yet to take a decision which will soon make the matter infructuous. 

 

The Delhi High court had also step back this month to interfere in this matter after being informed the Bombay High Court, as well as the Election Commission, was already seized of the issue.
